Terms of Service

"You", "your", and "Client" refer to any individual or entity accessing or using VivaPay Services. By using our Services, you consent to the collection, use, and processing of your personal information according to our Privacy Policy.

Your continued use of VivaPay constitutes agreement to these Terms. If you do not accept them, do not use our Services.

VivaPay may update these Terms from time to time to reflect operational, legal, or regulatory changes. Continued use of the Services 14 days after publication of updated Terms constitutes acceptance of those changes.

You must provide accurate personal information, including government-issued identification, proof of residence, date of birth, and financial source documentation.

Additional verification may be required during login or transactions to comply with AML/KYC regulations. Accounts for users under 18 will be immediately terminated.

VivaPay provides services for purchasing, holding, and selling supported cryptocurrencies, using fiat currency including USD, EUR, and GBP.

Cryptocurrency exchange rates are determined at the moment of transaction execution and may fluctuate rapidly. Minimum order sizes and applicable fees are listed on the VivaPay platform.

VivaPay may impose transaction limits for compliance and liquidity purposes. All cryptocurrency purchases are final and irreversible once sent to an external wallet.

Payments are considered confirmed upon verification of funds receipt. Refunds for failed transactions may be processed at VivaPay's discretion, subject to payment processing fees.

Chargebacks or reversal of confirmed payments may result in account suspension and reporting to authorities. All receipts and transaction confirmations should be retained for at least 3 months.

Users must be at least 18 years old or of legal age in their jurisdiction. Residents of restricted territories (e.g., North Korea, Iran, Russia, Sudan, and others as updated) may not access our Services.

Only one personal account per user is permitted. You must protect login credentials; unauthorized access is your responsibility. VivaPay may offset balances in case of unpaid obligations.

All software, content, and trademarks belong to VivaPay or licensed third parties. Forbidden practices include copying, modifying, distributing, reverse engineering, or unauthorized use of VivaPay intellectual property.

Cryptocurrency transactions involve market volatility and potential financial loss. VivaPay does not provide investment advice or guarantee profitability. By using the Services, you acknowledge and accept all associated risks.

Services are provided "as-is" without warranties. VivaPay is not liable for lost profits, transaction errors, market losses, or unauthorized access, except in cases of gross negligence.

Transfers to external wallets are irreversible. Force Majeure events (e.g., network failures, natural disasters, government actions) exempt VivaPay from liability.

VivaPay may suspend or terminate accounts for non-compliance with Terms, fraudulent activity, inactivity for six months or more, legal or regulatory obligations, or multiple accounts.

Users may request termination by emailing support@vivapay.com, effective upon account closure within 7 calendar days.

These Terms are governed by Estonian law. Disputes shall be resolved in Estonian courts, unless otherwise required by applicable law. EU residents may submit disputes via the European Commission Online Dispute Resolution Platform.
